1. General Terms

These Terms of Service ("Terms") form a binding legal agreement between you and MPIT PTY LTD, an Australian company registered in Queensland with ABN 36 639 649 308 and registered office at 2/4 Coobowie Street, Broadbeach Waters, QLD 4218, Australia (referred to in these Terms as "MPIT", "we", "us" or "our"). They govern your access to and use of the Deksino Player application ("Application") and the deksino.com website (collectively, the "Services").

By downloading, installing, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must discontinue use of the Services immediately. Your continued use of the Services constitutes your acceptance of the current Terms and any amendments that may be made thereto.

2. Service Description: Player Only, No Content

Deksino Player is strictly a software middleware and media player application. MPIT PTY LTD does not provide, host, sell, distribute, promote, recommend or control any media content, television channels, movies, sports streams, IPTV service, playlist, EPG data or streaming service of any kind. The Application does not store, transmit, broadcast or relay any audiovisual content whatsoever.

Users (or, in the case of business deployments, the operator of the venue or service) enter their own portal URLs through the Application to access content from their own third-party content providers. MPIT PTY LTD has no partnership, affiliation, business relationship or technical connection with any such third-party content providers, and is not aware of and does not validate the lawfulness of the content available through any portal URL.

All responsibility for the lawful sourcing, licensing and use of any content accessed through the Application lies entirely with the user or operator. MPIT PTY LTD makes no representations or warranties regarding the legality, accuracy, quality, availability, or reliability of any content accessed by users through third-party portal URLs. Users and operators must ensure that all content sources are legally licensed and authorised for distribution in their jurisdiction.

3. User Responsibilities

By using the Application, you agree to the following obligations:

  • Comply with all applicable local, national, and international laws, statutes, and regulations in connection with your use of the Application.
  • Respect intellectual property rights, copyrights, trademarks, and all other proprietary rights of third parties.
  • Ensure that any portal URLs entered into the Application are obtained from legitimate and authorized sources.
  • Maintain the confidentiality and security of your account credentials, and accept full responsibility for all activities that occur under your account.
  • Refrain from misusing the Application or engaging in any conduct that could adversely affect the experience of other users.
  • Not share any information obtained through the Application with third parties in an unlawful manner.

4. Intellectual Property

The Deksino Player application, including but not limited to its user interface design, logo, graphic elements, software code, database structure, and all related intellectual property rights, are the exclusive property of MPIT PTY LTD or its licensors. These rights are protected under applicable intellectual property laws and international treaties.

The following actions are strictly prohibited:

  • Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code of the Application.
  • Copying, reproducing, modifying, adapting, or creating derivative works based on the Application or any of its components.
  • Using MPIT PTY LTD's or Deksino's trademarks, logos, or other distinctive marks without prior written authorization.
  • Attempting to circumvent, disable, or interfere with any technological protection measures applied to the Application.

5. License Grant

Subject to your compliance with these Terms, MPIT PTY LTD grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable, and limited license to use the Application.

Under this license:

  • The Application may be used for personal, non-commercial purposes free of charge, unless otherwise expressly authorized in writing by MPIT PTY LTD.
  • Commercial, white-label, hospitality and enterprise deployments require a separate written licensing agreement with MPIT PTY LTD. Contact support@deksino.com for business licensing.
  • This license may not be assigned, transferred, or sublicensed to any third party.
  • MPIT PTY LTD reserves the right to revoke this license at any time, for any reason, at its sole discretion.
  • Upon termination of this license, you must immediately cease all use of the Application and remove it from all of your devices.

6. Prohibited Uses

The following uses are strictly prohibited and constitute a material breach of these Terms:

  • Using the Application to access copyrighted content without proper authorization from the rights holder.
  • Accessing illegal, harmful, threatening, defamatory, libelous, or otherwise objectionable content through the Application.
  • Copying, distributing, republishing, or selling the Application or any portion thereof without express written permission.
  • Attempting to exploit, bypass, or test security vulnerabilities within the Application or its infrastructure.
  • Performing any action that could damage, overburden, or disrupt the servers, networks, or infrastructure supporting the Application.
  • Interfering with or adversely affecting other users' ability to access or use the Application.
  • Using automated tools, bots, scrapers, or similar technologies to interact with the Application.
  • Using the Application in any manner that violates any applicable law, regulation, or ordinance.

7. Limitation of Liability

The Application is provided on an "as is" and "as available" basis. MPIT PTY LTD makes no express or implied warranties that the Application will be uninterrupted, error-free, or secure.

MPIT PTY LTD shall not be held liable for:

  • The legality, accuracy, reliability, or quality of any third-party content accessed by users through the Application.
  • The security or legality of any portal URLs entered by users.
  • The actions, omissions, or policies of third-party service providers.
  • Any direct, indirect, incidental, special, punitive, or consequential damages arising from or related to the use of the Application.
  • Loss of data, loss of business, loss of profits, or loss of reputation.

To the maximum extent permitted by applicable law (including the non-excludable rights and remedies of consumers under the Australian Consumer Law), MPIT PTY LTD's total aggregate liability under these Terms shall not exceed the total amount paid by the user for the Application during the twelve (12) months immediately preceding the event giving rise to the claim. If the Application has been used free of charge, this liability cap shall be deemed zero (0).

8. Account Suspension and Termination

MPIT PTY LTD reserves the right to suspend, restrict, or permanently terminate your account, with or without prior notice, under any of the following circumstances:

  • Violation of any provision of these Terms.
  • Detection of or reasonable suspicion that the Application is being used for unlawful purposes.
  • Conduct that jeopardizes the rights, safety, or security of other users.
  • Requests from legal authorities or court orders.
  • Technical, security, or operational reasons as determined by Deksino in its sole discretion.

Upon termination of your account, your right to access and use the Application shall cease immediately. Any obligations incurred prior to termination, and any provisions of these Terms that by their nature are intended to survive termination, shall remain in full force and effect.

9. Modifications

MPIT PTY LTD reserves the right to modify, update, or revise these Terms at any time, at its sole discretion. Material changes to these Terms will be communicated to users through one or more of the following methods:

  • In-app notifications.
  • Updated Terms published on our website.
  • Notice sent to the email address associated with your account.

Your continued use of the Application following the effective date of any modifications constitutes your acceptance of the updated Terms. If you do not agree with the revised Terms, you must discontinue use of the Application.

The most current version of these Terms is always available on this page. We recommend that you periodically review the "Last updated" date at the top of this page.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws in force in the State of Queensland, Australia, without regard to conflict of law principles. The parties submit to the exclusive jurisdiction of the courts of Queensland, Australia, and the courts of appeal from them, in respect of any dispute, controversy or claim arising out of or relating to these Terms, the Application, or any related matter.

Both parties agree to first attempt to resolve any dispute through mutual consultation and good-faith dialogue before pursuing formal legal proceedings. Nothing in these Terms limits any non-excludable rights you may have under the Australian Consumer Law.
